Welcome to Fund Momentum! These Terms of Service ("Terms") govern your use of the Fund Momentum website, applications, and services (collectively, the "Service"), operated by Fund Momentum ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Free Access and Optional Subscriptions

Core Platform is Free: Fund Momentum is committed to democratizing access to capital. All core features—including fund discovery, advanced filtering, viewing full fund details, saving favorites, and Excel data export—are completely free for all registered users. There is no paywall for these essential tools.

Optional Support & Premium Features: We may offer optional premium plans for users who wish to support our mission or access additional specialized features in the future.

Billing: We use Stripe, a third-party payment processor, to handle payments for any optional premium features or support plans. By providing a payment method for these optional services, you authorize us (through Stripe) to charge the applicable fees.

Cancellation: If you choose to subscribe to an optional recurring plan, you can cancel at any time through your account settings. Your cancellation will take effect at the end of the current billing cycle.

Refunds: All payments are non-refundable, always.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations.
  • Scrape, data-mine, or otherwise extract data from the Service for any commercial purpose without our express written consent.
  • Infringe on the intellectual property rights of others.
  • Transmit any viruses, malware, or other malicious code.
  • Interfere with or disrupt the integrity or performance of the Service.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Fund Momentum and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Disclaimers and Limitation of Liability

Disclaimer of Warranties: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, or completeness of the data provided. We do not guarantee that you will secure funding by using our Service.

Limitation of Liability: In no event shall Fund Momentum Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

6. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
